1. AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you and Ballmecca Inc. ("Company," "we," "us," or "our"), concerning your access to and use of the https://ballmecca.com website and any related media, mobile website or mobile application. We are registered in Maryland, United States at 4709 Harford Rd #163, Baltimore, MD 21214.

By accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, YOU ARE PROHIBITED FROM USING THE SITE AND MUST DISCONTINUE USE IMMEDIATELY.

You waive all moral rights to your Contributions, and you warrant that moral rights have not been asserted. You retain ownership of all Contributions, but we have the right to edit, redact, re-categorize, or delete any Contributions at any time.

7. GUIDELINES FOR REVIEWS

When posting reviews, you must comply with the following:

  • Have firsthand experience with the person/entity being reviewed
  • Not include offensive profanity or abusive language
  • Not include discriminatory references
  • Not reference illegal activity
  • Not post false or misleading statements
  • Not organize campaigns encouraging others to post reviews

8. SITE MANAGEMENT

We reserve the right to: monitor the Site for violations; take legal action against violators; refuse or restrict access to content; remove excessive or burdensome files; and otherwise manage the Site to protect our rights and facilitate proper functioning.

9. TERM AND TERMINATION

These Terms are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles.

12. DISPUTE RESOLUTION

Informal Negotiations: The Parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration.

Binding Arbitration: If informal negotiations fail, the Dispute will be finally and exclusively resolved through binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (AAA).

Jurisdiction: Any litigation shall be commenced in the state and federal courts located in Baltimore City, Maryland.

13. DISCLAIMER

THE SITE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE SITE WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE SITE'S CONTENT.

14. LIMITATIONS OF LIABILITY

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES. OUR LIABILITY TO YOU WILL AT ALL TIMES BE LIMITED TO THE LESSER OF THE AMOUNT PAID BY YOU DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION OR $200.00 USD.

You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, claim, or demand made by any third party due to: your Contributions; use of the Site; breach of these Terms; any breach of your representations; your violation of third-party rights; or any harmful act toward other users.

Returns Policy

Refunds

All sales are final and no refund will be issued.

Refund Policy: At Ballmecca, we strive to ensure customer satisfaction. However, as a general rule, we do not issue refunds once a coaching service has been provided. If you believe there are extenuating circumstances that warrant a refund, please contact our support team at support@ballmecca.com within 48 hours of receiving your service.

While we maintain a policy of no refunds, we reserve the right to make exceptions at our sole discretion on a case-by-case basis. Please note that contacting our team within the specified 48-hour window does not guarantee a refund, as decisions are made based on the specifics of each individual case.

Acceptable Use Policy
